What is the short-term-rental loophole?
It's the common name for clearing IRC section 469's passive-activity-loss rules through Treas. Reg. 1.469-1T(e)(3)(ii): an average guest stay of 7 days or less (or 30 days or less with substantial services) takes the activity out of the automatic passive rental-activity bucket. That alone doesn't free a loss to offset other income — you also have to materially participate.
Why can my cash flow be positive while I still show a tax loss?
Depreciation is a real tax deduction but not a cash expense. If your annual depreciation exceeds the principal portion of your mortgage payment, your taxable income runs lower than your actual cash flow, and can go negative even while cash is still coming in.
Do I owe self-employment tax on my Airbnb income?
Only if you provide substantial, hotel-like services, daily housekeeping during a stay, meals, concierge, not just routine services like cleaning between guests or trash collection. This is a separate legal test from the passive-activity-loss loophole above; clearing one does not determine the other.
What counts as material participation?
The two tests most commonly cited for short-term rental owners are working more than 500 hours on the activity in the year, or working more than 100 hours and more than any other individual (including paid help). There are other, less common tests under Treas. Reg. 1.469-5T this calculator does not model.
